Definitions
“Platform” means the Hamour multi-tenant e-commerce service. “Merchant” or “you” means the business registering for an account. “Services” means the subscription, storefront, and related features provided to you.
Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us promptly of any unauthorized use.
Subscription and Billing
Fees, billing cycles, and payment methods are described at checkout and in your plan. Taxes may apply where required. Failure to pay may result in suspension or termination of access subject to applicable law and these terms.
Acceptable Use
You will not use the Platform for unlawful, fraudulent, or abusive purposes, including distributing malware, infringing intellectual property, or circumventing security. We may investigate and take action on violations.
Data and Privacy
We process personal and business data as described in our privacy practices. You are responsible for lawful collection and use of your customers’ data and for complying with applicable data protection laws.
Suspension and Termination
We may suspend or terminate access for breach of these terms, non-payment where permitted, or risk to the Platform or other users. You may terminate in accordance with your subscription terms.
Liability
To the maximum extent permitted by law, the Platform is provided “as is.” Limitations and exclusions of liability apply as permitted by law; nothing excludes liability that cannot be excluded by law.
Governing Law
These terms are governed by the laws applicable to your agreement with Hamour, without regard to conflict-of-law rules. Disputes shall be resolved in the courts or forums specified in your commercial agreement, where applicable.
